PICTON AUTO GROUP REFUND POLICY
Reservation Security Deposits
All rentals require a Refundable Security Deposit to secure the vehicle.
This amount is applied toward the total rental cost at the time of pickup. This charge is to cover the vehicle incase of any expenses incurred during your trip.
Fees Including (but not limited to):
- Overmileage Fees
- Fuel Charges
- Highway Toll Charges
- Any Damage and or Scratch to the Vehicle
- Speed Violation Charges
PICTON AUTO GROUP LLC (“Company”) reserves the right to retain the Renter’s security deposit for a period of up to fourteen (14) business days following the conclusion of the rental period. This retention period allows the Company to complete a thorough inspection of the vehicle, verify mileage, assess for damages, confirm the payment of any tolls, citations, or outstanding balances, and review compliance with all terms of the Rental Agreement.
Should the Company determine, at its sole and absolute discretion, that the Renter has violated any provision of the Rental Agreement—including but not limited to misuse of the vehicle, failure to return the vehicle in its original condition, excess mileage, late return, unpaid tolls or fees, traffic violations, or any other breach—the Company reserves the right to withhold, apply, or permanently retain all or any portion of the security deposit to offset any costs, damages, penalties, losses, or administrative expenses incurred as a result.
All determinations made by PICTON AUTO GROUP LLC with respect to the withholding or forfeiture of the security deposit shall be final, conclusive, and binding upon the Renter.
2. Rental Balance Payments
The remaining balance for all rentals is due at the time of vehicle pickup or no later than twenty-four (24) hours prior to any scheduled delivery or chauffeured service, whichever applies.
Once a rental has been booked whether online, by telephone, or in person NO REFUNDS shall be issued under any circumstances. By submitting payment and confirming the reservation, the Renter acknowledges and agrees that all payments are FINAL and NON-REFUNDABLE.
Should the ("Renter") cancel or fail to take possession of the vehicle for any reason, PICTON AUTO GROUP LLC, at its sole and absolute discretion, may issue a future rental credit to be applied toward a later booking. The issuance and terms of any such credit shall be determined exclusively by the PICTON AUTO GROUP LLC ("company") and do not constitute a waiver of this NO-REFUND POLICY.
Once the vehicle has been picked up or delivered to the Renter, the transaction is deemed FULLY COMPLETED, and NO-REFUNDS, ADJUSTMENTS, or CHARGE REVERSALS shall be permitted. Unless the vehicle has been deemed in NON-RENTABLE condition.
3. Cancellation Policy

Refund percentages apply solely to prepaid rental fees and shall in no event apply to security deposits. The ("customer") expressly acknowledges, understands, and agrees to the foregoing terms without exception.
Furthermore, the ("customer") understands and agrees that once a booking is placed and a confirmation is issued whether online, by telephone, or in person there are absolutely no refunds under any circumstances.
At the sole discretion of PICTON AUTO GROUP LLC, a future rental credit may be extended as a courtesy; however, such credit shall not constitute or imply any entitlement to a monetary refund.
4. Changes to Reservations
All reservation modifications are subject to vehicle availability and require prior written approval from PICTON AUTO GROUP LLC. Any approved changes may be subject to rate adjustments or additional fees based on vehicle class, rental duration, or seasonal pricing.
Change requests submitted within twenty-four (24) hours of the scheduled pickup or delivery time may, at the sole discretion of PICTON AUTO GROUP LLC, be treated as a cancellation and remain fully non-refundable.
5. Vehicle Condition / Damage Responsibility
Once the vehicle has been released into the Renter’s possession, all payments are considered final and NON-REFUNDABLE. This includes, but is not limited to, circumstances involving:
- Early returns
- Weather conditions
- Changed travel plans
- Personal preferences or dissatisfaction
The Renter assumes full responsibility for the vehicle and agrees to cover all damages, excessive mileage, tolls, traffic violations, citations, and any associated costs incurred during the rental period.
If the vehicle is returned prior to the scheduled return date, no credits, reimbursements, or partial refunds shall be provided under any circumstances.
6. Vehicle Inoperability or Substitution
In the event that a reserved vehicle becomes unavailable due to mechanical failure, prior damage, or other unforeseen circumstances beyond the control of PICTON AUTO GROUP LLC (“Company”), the Company shall, at its sole and absolute discretion, provide one of the following remedies:

Comparable Replacement:
A comparable or upgraded vehicle will be offered at no additional cost to the Renter, subject to fleet availability; or -
Store Credit:
A store credit equal to the value of the original rental will be issued, valid for a period of twelve (12) months from the original rental date.
Refunds will be issued only in the event that a comparable replacement vehicle is not available and no future rental credit is elected by the Renter.
The Renter acknowledges and agrees that mechanical issues, prior damage, or fleet availability changes may occur from time to time and do not constitute breach of contract by PICTON AUTO GROUP LLC.
7. Payment Disputes & Chargebacks
Any UNAUTHORIZED, FALSE, or FRAUDULENT PAYMENT DISPUTE, CHARGEBACK, or CLAIM OF NON-DELIVERY shall constitute a material breach of this Rental Agreement under the laws of the State of Texas. In such event, PICTON AUTO GROUP LLC (“Company”) shall be entitled to pursue all civil and criminal remedies available, and the Renter expressly agrees to the following terms and conditions:

Immediate Termination: The Rental Agreement shall be deemed immediately terminated for cause, and all fees, deposits, and payments made shall be forfeited in full.

Administrative Fee: A two hundred fifty-dollar ($250.00) administrative and processing fee shall be assessed and added to any balance due to offset investigation, documentation, and processing costs.

Recovery and Legal Costs: The Renter shall be liable for all costs of recovery, including but not limited to attorney’s fees, court costs, collection expenses, and chargeback processing fees, as permitted under Texas Civil Practice and Remedies Code §38.001 et seq.

Reporting of Misappropriation: In the event the vehicle is not returned, or if a fraudulent dispute is filed while the vehicle remains in the Renter’s possession, the Company reserves the right to report the vehicle as misappropriated property to law enforcement under Texas Penal Code §31.04 (Theft of Service) or other applicable statutes.

Governing Law: This provision and all related enforcement actions shall be governed by and construed in accordance with the laws of the State of Texas, and any legal proceedings shall be brought exclusively in the courts of Dallas County, Texas.
Filing or attempting to file a false, malicious, or fraudulent chargeback may constitute credit card fraud, theft of services, or misrepresentation under both Texas and federal law, and the Company reserves all rights to seek criminal prosecution and civil restitution.
Renters are strongly encouraged to contact PICTON AUTO GROUP LLC directly to resolve any billing or service concerns prior to initiating any payment dispute, in order to avoid additional penalties, fees, or legal action.
8. Acceptance of Terms
By submitting a reservation, payment, or rental request with PICTON AUTO GROUP LLC (“Company”), the Renter hereby acknowledges, accepts, and agrees to be legally bound by all terms, conditions, and policies contained within this document and the accompanying Rental Agreement.
This acknowledgment applies equally to all bookings made in person, online, by telephone, or through any authorized third-party platform.
The Renter further affirms that they have read, understood, and consented to the Company’s Payment, Deposit, Cancellation, and Liability provisions, and agree that these terms shall govern any and all rental transactions with the Company.
